To whom it may concern,
As a result of the developments in Ukraine due to the Russian war of aggression, the European Union has issued several sanctions packages. Some of these measures are causing great uncertainty among companies. The undersigned therefore issues the following declaration on behalf of Rittal GmbH & Co. KG ("Rittal").
With regard to Council Regulation (EU) 2023/1214 of 23 June 2023 amending Council Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine, the undersigned assures full compliance with the aforementioned regulations as well as with all published sanctions packages. In particular, it is confirmed that:
- all business and sales activities within Russia have been stopped
- the goods sold by Rittal do not originate in Russia, Belarus, the Autonomous Republic of Crimea or the territories occupied in Ukraine (Donetsk, Luhansk, Zaporizhia or Kherson)
- the goods were not processed in a non-EU country using steel and iron products originating in Russia, regardless of whether the contractor is a contractor based inside or outside the European Union (Art. 3g of Regulation (EU) No. 833/2014)
- neither Rittal itself nor any party in its supply chain is a person or entity located in Russia, is not more than 50% directly or indirectly owned by such a person or entity, or is not acting on behalf of or by order of such a person or entity.
With regard to international export control regulations, in particular the US Export Administration Regulations (EAR), the US International Traffic in Arms Regulations (ITAR), the German Foreign Trade and Payments Act (AWV) and the EU Dual-Use Regulation (Regulation (EU) 2021/821), the undersigned confirms that:
- the goods are not exported, re-exported or passed on to third parties without complying with the
requirements of the European export control regulations, the EAR and ITAR or the applicable national export control regulations - the goods are not delivered or sold to countries in which there is an EU or US embargo on these goods
- goods are not supplied or sold to persons or organizations on an EU or US sanctions list
- there is no positive knowledge that the goods sold by Rittal are used for the development, production, handling, operation, maintenance, storage or proliferation of chemical, biological or nuclear weapons
